This editorial examines the significance of studying the development of public law during the Constitutional Revolution in Iran and argues that this historical period remains essential for understanding the contemporary challenges of the Iranian legal system. It first outlines the principal reasons why revisiting the Constitutional era continues to be necessary, even in times of national crisis, and then proposes a conceptual framework for analyzing the enduring structural obstacles that have shaped the trajectory of Iranian public law over the past 120 years. The editorial identifies five persistent legal constraints:
institutional rigidity, linguistic and conceptual misunderstanding, exhausting temporal asymmetry within society, the unresolved coexistence of sacred and secular sources of legitimacy, and the absence of effective intermediary institutions between society and political power. Rather than viewing these challenges as isolated or accidental phenomena, the article argues that they are historically rooted and continuously reproduced through recurring institutional and social dynamics. It concludes that strengthening the rule of law requires not only legislative reform but also a deeper understanding of the historical evolution of Iran's legal institutions and the structural conditions that have sustained these enduring constraints.
