Adopting a historical-cross-sectional approach, the study examines the contrasting roles of two pivotal factions during the Constitutional era: the Democrat Party, characterized by its liberal and radical reformist agenda, and the Moderate Socialists Party, which maintained conservative and religious leanings. The findings suggest that deep-seated ideological divisions specifically regarding the sources of political legitimacy, the intersection of religion and state, the nature of representative governance, and partisan methodology impeded the movement’s progress.<br>These internal conflicts, exacerbated by the absence of foundational socio-economic prerequisites such as a robust urban middle class and an industrial economy, culminated in frequent physical confrontations and political instability. Ultimately, this study argues that the rivalry between these parties and the structural inadequacies of the era contributed to the incomplete consolidation of constitutional norms and the stunted development of constitutional rights in Iran. <span dir="RTL" lang="AR-SA"> ابتدا مفهوم دستورگرایی به‌عنوان نهضتی تاریخی که بر حاکمیت قانون اساسی مکتوب در برابر عرف‌های سیاسی تأکید دارد، تبیین می‌شود. سپس، با روش تاریخی - مقطعی در قبال عصر مشروطه، نقش دو حزب اثرگذار دموکرات (با گرایش لیبرال و رادیکال) و اجتماعیون اعتدالیون (با گرایش محافظه‌کار و مذهبی) در تقویت یا تضعیف این جریان بررسی می‌گردد. یافته‌ها نشان می‌دهد اختلاف‌های بنیادین این دو حزب در مفاهیمی چون منبع مشروعیت، نسبت دین و سیاست، نظام نمایندگی و تحزب، همراه با فقدان زمینه‌های</span><span lang="AR-SA">اقتصادی - اجتماعی لازم (نظیر طبقه متوسط شهری و اقتصاد صنعتی) برای دستورگرایی، و نیز درگیری‌های عملی و استفاده از حذف فیزیکی، در نهایت به شکست نسبی نهضت مشروطه و عدم تثبیت کامل دستورگرایی و توسعه حقوق اساسی در ایران انجامید.</span> https://jrpl.illrc.ac.ir/article_735849_acd387729ff6efbb8f76172fed4f5152.pdf
